AI Terms of Use – Caesarstone Digital Platforms

This Artificial Intelligence (AI) Terms of Use (“AI Terms”) governs your access to and use of any AI-generated or AI-assisted features, content, or tools made available by Caesarstone. These may include, without limitation, functionalities powered by artificial intelligence technologies such as machine learning models, predictive tools, automated suggestions, chatbots, AI-enhanced search, visual renderings, design recommendations, and other interactive outputs—whether developed by Caesarstone or integrated through third-party platforms (collectively, “AI Features”).  These AI Features are provided through Caesarstone websites, including but not limited to [https://csstudio.caesarstone.ca/] (collectively, the “Sites”) [and, where applicable, through Caesarstone mobile applications].

By accessing or using the AI Features and Sites, you acknowledge that you have read, understood, and agree to these AI Terms, as well as Caesarstone’s Terms of Use, Privacy Policy, and any additional legal notices referenced on the Sites.

  1. Purpose and Intended Use

Certain features or content on our Sites may incorporate AI Features. The AI Features are intended to enhance your experience and support creative or planning processes by offering tools for inspiration, design exploration, and planning assistance, etc. These include, without limitation, visual representations of materials, design suggestions, and content recommendations. The AI Features are informational and illustrative only, and do not constitute professional advice, final product specifications, or technical guidance.

  1. Accuracy and Limitations

The outputs generated by AI Features are based on algorithmic models, available data, and design logic. While we strive to ensure a helpful and engaging experience:

  • AI Features provide responses that are artificially generated and may contain inaccuracies, outdated information, or content not reflective of actual Caesarstone products, availability, or guidance.
  • You should not rely solely on the responses or suggestions provided by the AI Features. For any critical, legal, safety-related, or design decisions, please refer to official Caesarstone documentation, consult a Caesarstone representative, or rely on physical product samples.
  • The AI Features are provided on an “AS IS” and “AS AVAILABLE” basis.
  • The specific output generated is based on prompts or selections made by the user and may not be anticipated or reviewed in advance.
  • AI Features may generate content that you find offensive, inaccurate, or inconsistent with Caesarstone’s views. By using the AI Features, you acknowledge and accept this risk and agree that Caesarstone is not responsible for any such content or the consequences of relying on it.

To the maximum extent permitted by law, Caesarstone:

  • Makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or availability of any AI-generated outputs;
  • Disclaims all liability for any errors, omissions, disruptions, delays, or inconsistencies in the operation or results of AI Features; and
  • Does not guarantee that use of the AI Features will be secure, uninterrupted, or free of defects; and
  • Is not responsible for any actions you take in reliance on AI-generated outputs based on your prompts or selections.
  1. User Responsibility

When using the AI Features, you agree not to:

  • Use the tools in any way that violates applicable laws, regulations, or third-party rights.
  • Input confidential, sensitive, or personally identifiable information unless explicitly requested and governed by a separate agreement.
  • Misuse or reverse-engineer AI models or attempt to extract proprietary logic or datasets.
  • Present AI outputs as verified facts, official recommendations, or Caesarstone-approved specifications.
  • Use AI outputs in any way that is misleading, unlawful, or inconsistent with applicable design, building, or safety standards.

Users are solely responsible for verifying any output provided by AI Features before relying on it in practice.

  1. Intellectual Property

Unless otherwise stated:

  • All AI-generated content is the intellectual property of Caesarstone or its licensors.
  • You are granted a limited, non-exclusive, non-transferable right to use AI-generated outputs solely for personal or internal business use in connection with Caesarstone products or services.
  • Any user-provided inputs submitted through AI Features (such as uploaded content or configuration preferences) remain your property, but you grant Caesarstone a royalty-free, perpetual license to use them in anonymized or aggregated form to improve services.
  1. Third-Party AI Features

Some AI Features may be supported by external technology providers. Your use of such features may also be subject to their respective terms of service and privacy practices. Caesarstone is not responsible for the performance, content accuracy, or data privacy practices of these third-party tools.

  1. Privacy and Data Use

Use of AI Features is subject to Caesarstone’s Privacy Policy. We do not use your identifiable personal data to train AI models unless explicitly disclosed and consented to. Non-identifiable or aggregated inputs, submitted by users through AI Features, may be used by Caesarstone for system optimization, performance analysis, and service enhancement. We may monitor usage of AI Features for analytics, performance optimization, or misuse detection, in accordance with applicable data protection laws.

Do not input sensitive personal or confidential information into AI Features unless specifically required for a defined purpose under an applicable agreement.

  1. Limitations on Liability

To the fullest extent permitted by applicable law, Caesarstone shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including but not limited to lost profits, revenues, data, or other intangible losses, resulting from or related to your use of the AI Features, even if Caesarstone has been advised of the possibility of such damages. This limitation applies regardless of the legal theory, including negligence or strict liability.

Jurisdiction-Specific Limitations – Certain jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such cases, these AI Terms shall apply to the maximum extent permitted by the laws of your country or state of residence.

  1. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Caesarstone, its affiliates, subsidiaries, officers, employees, agents, partners, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the AI Features;
  • Your violation of these AI Terms or any applicable law or regulation;
  • Your violation of any third-party rights, including intellectual property or data privacy.
  1. Modifications and Updates

Caesarstone reserves the right, at its sole discretion, to revise, modify or change or remove portions or all of these AI Terms, at any time. Continued use of the Sites after such changes constitutes acceptance of the revised AI Terms.  

In addition, Caesarstone may, from time to time, provide enhancements or improvements to the AI Features, which may include patches, updates, or other modifications (“Updates”). These Updates may add, modify, or remove certain features or functionalities of the AI Features. Caesarstone does not have any obligation to:

  • Provide any specific Updates; or
  • Continue offering or enabling any particular AI Feature or functionality.

All Updates will be considered an integral part of the AI Features and will be governed by these AI Terms. Caesarstone also reserves the right to discontinue or suspend any AI Feature at any time. 

  1.  Severability and Waiver

If any provision of these AI Terms is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be construed, limited, or, if necessary, severed to the minimum extent required to make it enforceable, and the remaining provisions shall remain in full force and effect—unless the overall intent of these AI Terms cannot be achieved without the unenforceable portion.

Failure by Caesarstone to enforce any right or provision of these AI Terms shall not constitute a waiver of such right or provision. Any waiver or modification of these AI Terms must be made in writing and signed by an authorized representative of Caesarstone to be valid and enforceable.

  1.  Governing Law and Jurisdiction

These AI Terms shall be governed by, and any dispute arising from or related to them shall be resolved in accordance with, the governing law and jurisdiction rules set out in the Caesarstone Terms of Use, including the applicable provisions based on your country of residence.

By using the AI Features, you agree that any legal action, claim, or dispute shall be resolved in accordance with the applicable law and court jurisdiction defined in those Terms of Use.
